Slip and fall accidents are one of the most common ways that people are injured as the result of someone else’s negligence. Even though these claims are common, it can be difficult to win these types of cases. There are, however, some steps you can take to make it more likely that you will be successful in your case.

First, immediately after your fall, you should seek medical attention, if necessary. Your health and recovery should  be your top priority. Seeking appropriate medical treatment can help you heal and prevent further injury. Your medical treatment may also help your legal case by showing that you suffered damages as a result of your fall.

After your fall, you should make a report at the location where you fell. Let the store manager, landlord, or homeowner know about the accident. Clearly state where you fell and what caused you to fall. If a report is taken and you are asked to sign it, read it carefully to make sure that it accurately communicates what you told the individual taking the report. You should also make a note of the individual who wrote the report, and ask for a copy of it. If you are unable to make a report immediately after your fall because of your injuries, call back as quickly as possible to make a report over the phone.

It’s also critical that you preserve evidence of your fall. If you were in a store or restaurant and the fall occurred after you purchased something, save your receipt. You may also have a receipt for parking. Those receipts will help prove that you were at the business location, if that fact is later disputed.

You should also save any shoes and clothing you wore at the time of the fall. If there was a substance on the floor that caused your fall, and you aren’t quite sure what the substance was, testing can be performed on your shoes and clothing.

Photos can also be invaluable to a slip and fall case. Take pictures immediately after the accident if you are able. You should take pictures of the exact area where you fell, any substances that were on the floor that may have caused you to fall, your injuries, and any damage to your clothing or footwear.

Witnesses are also very helpful in providing evidence for a slip and fall case. Witnesses can help verify that you fell, where the fall occurred, what time the fall occurred, what caused your fall, and other necessary information. If you are able, get as much contract information from the witness or witnesses as possible after your fall. At a minimum, obtain a name and phone number for each witness.

Finally, you should speak to an attorney after your accident. An attorney can be extremely valuable to an injured person’s case. Time is not on your side, so you should speak to an attorney as quickly as possible. An attorney can help advise you on the law and your legal options. The attorney can help you gather and preserve evidence in your case. Your attorney can help advise you on how to deal with an insurance company, and advise you when to settle or take your case to court.
